1. Agreement to Terms

Welcome to Discenius. These Terms of Service ("Terms") govern your access to and use of the Discenius platform operated by APP DEV MASTERS LTD ("Company", "we", "us", or "our").

By accessing or using Discenius, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our services.

2. Eligibility

To use Discenius, you must:

• Be at least 13 years old (or 16 in the European Economic Area)
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

3. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activities.

4. Description of Services

Discenius provides an AI-powered learning platform that offers:

• Study Plans: AI-generated personalized study plans based on your learning goals
• Books: Comprehensive book content generated from study plans (paid feature)
• Content Generation: AI-powered content creation using OpenAI's GPT models
• Progress Tracking: Tools to monitor and track your learning progress

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice.

5. Pricing and Payments

5.1 Free Features

Creating an account and generating study plans is free of charge.

5.2 Paid Features

Book generation requires a one-time payment of $9.99 USD per study plan.

• All payments are processed securely through Stripe
• Prices are subject to change with notice
• You will be notified of any price changes before completing a purchase

5.3 Refund Policy

Refunds are handled on a case-by-case basis. You may request a refund if:

• The book generation fails due to technical issues on our end
• You were charged incorrectly or multiple times for the same purchase
• The content quality is significantly below reasonable expectations

To request a refund, contact us at info@appdevmasters.com within 14 days of purchase. Once book content has been successfully generated and delivered, refunds are generally not available.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of any content you provide to Discenius (study subjects, learning goals, etc.). By using our services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve our services.

6.2 AI-Generated Content

Content generated by our AI (study plans and books) is provided to you for personal, non-commercial use. While we generate this content for you, you acknowledge that:

• AI-generated content is created based on your inputs and may not be entirely unique
• You are responsible for reviewing and verifying the accuracy of AI-generated content
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• Generated books are for your personal educational use only

6.3 Our Intellectual Property

The Discenius platform, including its design, code, logos, and trademarks, is owned by APP DEV MASTERS LTD and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without prior written consent.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights of others
• Uploading malicious code, viruses, or harmful software
• Attempting to gain unauthorized access to our systems or other users' accounts
• Scraping, crawling, or harvesting data from our platform
• Using our services for any illegal or unauthorized purpose
• Reselling or commercially exploiting AI-generated content
• Creating multiple accounts to abuse free features
• Impersonating others or providing false information
• Interfering with the proper functioning of our services

8. Third-Party Services

Our platform integrates with third-party services including:

• OpenAI: For AI content generation
• Stripe: For payment processing
• Supabase: For backend infrastructure and authentication

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of third-party service providers.

9. Disclaimers and Limitations of Liability

9.1 Service "AS IS"

Discenius is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Content Accuracy

We do not guarantee the accuracy, completeness, reliability, or quality of AI-generated content. AI models may produce errors, inaccuracies, or outdated information. You are responsible for verifying and validating all content before relying on it.

9.3 Limitation of Liability

To the fullest extent permitted by law, APP DEV MASTERS LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers
• Any interruption or cessation of services
• Any errors or omissions in content
• Any conduct or content of third parties on the platform

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless APP DEV MASTERS LTD, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms
• Your use of our services
• Your violation of any rights of another party
• Any content you submit or generate using our platform

11. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Requests by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues

You may terminate your account at any time by contacting us at info@appdevmasters.com. Upon termination, your right to use our services will immediately cease.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our services shall be resolved through:

1. Informal Negotiation: First, contact us at info@appdevmasters.com to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, the parties agree to participate in mediation
3. Litigation: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice on our platform. Your continued use of our services after such notification constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using our services.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and APP DEV MASTERS LTD regarding the use of our services and supersede any prior agreements.
